SELLER DISCLOSURE
Description: This form discloses the condition of the property, including structural, mechanical, and environmental issues.
When Used: This form is provided to the buyer before the sale to inform them of any known issues with the property.
FINANCING ADDENDUM
Description: This addendum outlines the terms and conditions related to the buyer's financing of the property. It includes details on the type of loan the buyer is obtaining (e.g., conventional, FHA, VA), the amount to be financed, and the timeline for securing financing.
When Used: This addendum is used when the buyer’s offer is contingent on securing financing for the purchase of the property. (N/A if the buyer will purchase the home with CASH)
OPTIONAL CLAUSES ADDENDUM
Description: This form allows the inclusion of additional terms or conditions not covered in the main Purchase & Sale Agreement.
When Used: Used when either party wants to add terms that are not part of the standard contract but are mutually agreed upon. It is typically executed alongside the main agreement, after both parties have negotiated specific terms that may require further clarification or additional documentation.
FIRPTA (Foreign Investment in Real Property Tax Act) CERTIFICATION
Description: This certification is required by the IRS to confirm that the seller is not a foreign person, or to document the withholding tax obligations if the seller is a foreign person.
When Used: This form is provided during the closing process for real estate transactions to comply with the Foreign Investment in Real Property Tax Act (FIRPTA) regulations.
LEAD-BASED PAINT HAZARDS DISCLOSURE
Description: This form provides details regarding lead paint hazards, any known lead paint issues, and the buyer’s right to conduct an inspection for lead-based paint.
When Used: This disclosure is provided to the buyer during the purchase process of residential properties built before 1978, as required by federal law. It must be signed by both the seller and buyer to acknowledge the risks of lead-based paint and the buyer’s right to inspect.
IDENTIFICATION OF UTILITIES ADDENDUM
Description: This addendum provides a detailed list of the utilities servicing the property, including the names of providers for electricity, water, gas, sewer, and other essential services.
When Used: Used during the purchase process to ensure the buyer has a clear understanding of the utility services available to the property.
INSPECTION ADDENDUM
Description: This addendum outlines the terms and conditions for property inspections during a real estate transaction.
When Used: This addendum is used when the buyer includes an inspection contingency as part of their offer.
PURCHASE & SALE AGREEMENT
